केंद्रीय बजट 2015-16 के अपने बजट भाषण में वित्त मंत्री ने ठेके से संबंधित विवादों के समाधान के लिए संस्थागत व्यवस्था को कारगर बनाने की आवश्यकता पर बल दिया और लोक संविदा लागू करने के लिए विधेयक (विवादों के समाधान) का प्रस्ताव रखा। वित्त मंत्री के बजट भाषण का प्रासंगिक अंश इस प्रकार हैः

1. “सार्वजनिक ठेके में उत्पन्न होने वाले विवादों को हल करने की प्रक्रिया में काफी समय लगता है तथा यह प्रक्रिया महंगी भी है। मेरी सरकार इस तरह के विवादों के समाधान तथा संस्थागत व्यवस्था को कारगर बनाने के लिए, लोक संविदा (विवादों के समाधान) बिल पेश करने का प्रस्ताव रखती है”।

2. तदनुसार, लोक ठेके का प्रारंभिक मसौदा (विवादों के समाधान) विधेयक, 2015 तैयार किया गया है। प्रस्तावित कानून पीपीपी परियोजनाओं सहित परियोजनाओं के निर्माण और बुनियादी परियोजनाओं के लिए लोक प्राधिकरण द्वारा किए गए अनुबंध के साथ सौदा करने के लिए परिकल्पना की गई है।

3. विधेयक के मसौदे पर हितधारकों की टिप्पणी/विचार प्राप्त करने के लिए संलग्न किया गया है। विचारों को साझा करने के लिए अंतिम तिथि/समय 30 जून 2015, शाम 5:00 बजे तक है।

#PublicContracts.....The first of all the finance ministry, the law ministry and the Supreme court along with the PMO should meet to set up a system of Fast track courts; a governing body for mutual settlements of disputes. And above all a strong vigilance is in need for putting an to all type corruptions.

i want to add: 1.this must include public and pvt contract. 2.all judges and relevant offiers must be advocates and with updated knowledge and relevant and other qualification as for betterment. 3.time for award mest be given as fixed 4. give it finality and legal validity like court.

Recently i came to know that the 7.5 acre land of the sewree plant Balmer Lawrie is being planned to be sold to a private property dealer; when asked about this the management directly told that it was a Modi government policy and they have nothing to do about this. sir,construction standard & quality as gone down,unskillful do the jobs, shortage of skill labour, new generation don't want to learn mason job,plumbing,electrical,carpentry. daily wages of labour is 800 to 1000 a day. govt subsidiary on food made this class lazy.today average middle class cannot afford to hire for labour jobs,

It is good that the government has taken up such an initiative to resolve the issues relevant to this page. However, there should a bench of the Tribunal in each state and the only court of appeal should be the Supreme Court (provided it grants the leave to appeal). It is also imperative for the tribunal to be bound by the Code of Civil Procedure and the Indian Evidence Act. Otherwise, the members of the tribunal can pronounce biased judgments. #PublicContracts #Finance.

good points are faster proceedings and judgement , the periodic reports and the replacement of chairperson. but i feel the bill would be fruitful to much more people if it extends to ration shops also . the 2 clauses in the bill made me presume this,sorry if i am wrong.bill does not extend to mere supply of goods and it specifies the parties to sign the contract which i presume does not include implied and quasi contracts.if this is included it would help poor to get unadultered goods

#PublicContracts The "Decision to be by majority" part in the draft bill seems to be the place where the decisions will be taken against common public people.I am not sure whether this is the way all the tribunals works.But the way the green tribunal handled the Sterlite Industries (INDIA) Ltd. VS TNPCB Ors. case made it unclear that how it works...
